In consideration of the opportunity to participate in the above named event on dates indicated below, I voluntarily acknowledge and agree to the following:

 

 

SNEC-PMI is a wholly voluntary associate activity that is conducted by, for and on behalf of company associates and their guests.

 

SNEC-PMI sponsors activities purely for the social and recreational enjoyment of associates and their guests who voluntarily wish to participate.

 

Participation in the above-described event involves physical activity, which may expose me to the risk of personal injury or property damage.  I am voluntarily participating in this activity and agree to assume all risks arising from my participation in the event regardless of how they might arise.

 

I agree for myself, my heirs and assigns, executors and administrators to waive and release SNEC-PMI, PMI or any other sponsoring organization(s) and/or their subsidiaries, affiliates, officers, representatives or successors (“Released Parties”) from any and all losses, causes of action, liabilities, expenses and/or claims for damages (collectively “Claims”) I may have that might arise directly or indirectly from participation in connection with the Event and/or the condition of the property, facilities or equipment used for the Event, regardless of when such Claim may arise including, without limitation, Claims relating to (i) any theft, loss or disappearance of property, (ii) bodily injury (fatal or non-fatal) and (iii) property damage, in each case unless such Claim is caused solely by the gross negligence or willful misconduct of one or more Released Parties.

 

I grant permission for SNEC-PMI to use my name, likeness, voice, relevant biographical information and any other indicia of my identity in connection with the Event, and publicity, advertising and promotion for the event and other events in all forms of media throughout the world in perpetuity without remuneration I further agree that all photos, negatives, sounds, imagery, and video recordings and all copyrights therein shall be the sole property of SNEC-PMI and I waive any right I may have to inspect or approve any materials that may use such rights.

 

This waiver and release will be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. Any provisions found to be void or unenforceable shall be modified or deleted to the minimum extent necessary to make them enforceable, and shall not affect the enforceability of any other provisions.

 

I have read this Hold Harmless Agreement and Image Release, I fully understand its terms, and I recognize that I have given up rights by signing it in consideration of being permitted to participate in the event.  I sign it voluntarily and without any inducement or duress.

Hold Harmless Agreement and Photo Release

 

Why is a Hold Harmless Agreement necessary?

This is a risk management issue for SNEC-PMI.  Because we cannot control every aspect of a project, we cannot therefore be held liable for possible injury.  Many companies require similar signed agreements from their associate volunteers, retirees, and guests.

 

What if a volunteer refuses to sign the waiver form?

If an associate, retiree, or guest does not feel comfortable signing the waiver, he or she will not be permitted to participate in the project.

 

What does the Agreement mean when it says “I agree…to waive and release SNEC-PMI, PMI Corporation or any other sponsoring organization(s) and/or their subsidiaries, affiliates, officers, representatives or successors (“Released Parties”) from any and all losses, causes of action, liabilities, expenses and/or claims for damages (collectively “Claims”) I may have that might arise directly or indirectly from the Child’s participation in connection with the Event and/or the condition of the property, facilities or equipment used for the Event, regardless of when such Claim may arise including, without limitation, Claims relating to (i) any theft, loss or disappearance of property, (ii) bodily injury (fatal or non-fatal) and (iii) property damage, in each case unless such Claim is caused solely by the gross negligence or willful misconduct of one or more Released Parties. 

The language is used in order to protect not only the corporation as an entity from future action, but also the various individuals who represent the corporation who might be looked to for remedy.

 

What if I have friends/family of associates that participate in a SNEC-PMI project or activity?

SNEC-PMI encourages associates to include their friends and family members to participate in SNEC-PMI projects.  Any guest is also required to sign the Agreement.

 

What if I don’t want my photo taken?

If you do not want your photo taken, but still want to participate in the SNEC-PMI project, ask what possible photos may be taken and when, and make a conscious effort to remain away from that area at that time.  If possible, speak to the photographer and let them know you don’t want to be a part of any photos, realizing that when candid shots are taken, photographers cannot be looking for specific associates and guests in the shot.  We cannot guarantee that photos will not include you.
